A. DUI/DWI


This is when a person is driving while impaired and under the effect of alcohol or drugs. Officers are allowed to stop a car if they feel that a driver is driving while impaired. In such a case they will require the driver to submit to some form of chemical test, such as breath, blood, or urine test. Same goes if they stop a car for another traffic violation and suspect the driver of being under the influence. In Minnesota, and in all the rest of the states for that matter, If a driver refuses to submit to such testing, there is an implied assumption of guilt and the implied consent laws carry some penalties such as suspension of a driver's license for six months. If a person submits to a testing and has a blood alcohol content (BAC) at or above .08, such person is considered intoxicated. If a person is under 21 and has a trace of alcohol; BAC levels at .02 or above, they are considered intoxicated. There is a harsher penalty for people with high BAC at or above .20. Such offenders generally get additional jail time, harsher penalties, and more severe driver's license sanctions.
